1. Introduction

Welcome to FungaDeal. These Terms of Use govern your access to and use of our website, mobile web, and related services. By using FungaDeal, you agree to comply with these Terms and all applicable laws of Kenya. If you do not agree, please do not use the platform.

2. About FungaDeal

FungaDeal is an online classifieds marketplace in Kenya that connects buyers and sellers. We do not own, sell, inspect, or guarantee any item listed on the platform. Users interact and transact directly with each other. FungaDeal only provides the platform and optional paid promotional tools.

3. User Accounts

• You must be at least 18 years old to create an account.
• You may sign in using a Google account. You are responsible for keeping your login credentials secure.
• All profile information you provide must be accurate and truthful.
• We reserve the right to suspend, block, or terminate any account that violates these Terms or creates a risk to other users.

4. Listings and Content

• All listings must be truthful, accurate, and lawful.
• You may only list items or services that you have the right to sell or advertise.
• Prohibited listings include: illegal goods, counterfeit items, weapons, drugs, adult content, financial scams, and anything that violates Kenyan law.
• By posting a listing, you grant FungaDeal a license to display and promote your content on the platform.
• We may remove or edit any listing that violates our policies without notice.

5. Wallet, Payments and Promotions

• Your FungaDeal wallet can be topped up using M-Pesa and used to pay for promotional packages and other paid features.
• All wallet top-ups and promotional purchases are final and non-refundable unless otherwise stated.
• FungaDeal does not charge commission on direct sales between users.
• Pricing for promotions and packages is clearly displayed before purchase.

6. Refer & Earn Program

• Users may earn rewards by referring new users who register through a personal referral link.
• Referral earnings become available only after the referred user has been active for 24 hours and has not been blocked.
• Abuse, fake accounts, self-referrals, or any manipulation of the program is prohibited and may lead to forfeiture of earnings and account suspension.
• Cash withdrawals are processed manually to M-Pesa after admin review. Minimum withdrawal amounts and conversion rates are shown on the referral page.

7. Transactions Between Users

FungaDeal is not a party to any transaction between buyers and sellers. Users are solely responsible for negotiating, inspecting, paying, and delivering items. We strongly recommend using secure payment and escrow services such as Kenya Escrow when paying upfront.

8. Safety and Prohibited Conduct

• Do not share sensitive personal or financial information with other users.
• Do not harass, threaten, or discriminate against other users.
• Do not use automated tools, bots, or scrapers without permission.
• Do not attempt to bypass platform security or manipulate rankings.

9. Liability and Disclaimers

FungaDeal provides the platform "as is" and does not guarantee the accuracy, quality, or legality of listings. To the fullest extent permitted by law, FungaDeal is not liable for direct, indirect, or consequential damages arising from your use of the platform or any transaction between users.

10. Termination

We may suspend or terminate your account or access to the platform at any time if you violate these Terms or for any other reason. You may also delete your account or stop using the platform at any time.

11. Changes to These Terms

We may update these Terms of Use from time to time. Continued use of the platform after changes means you accept the updated Terms. The latest version will always be available on this page.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes will be resolved through the appropriate courts in Kenya.
